AGB

1. Scope

These General Terms and Conditions (GTC) apply to all contracts, deliveries and services between Sabuhi Mustafayev (Drywall / Interior Construction) – hereinafter referred to as 'Contractor' – and his clients – hereinafter referred to as 'Client' –, unless explicitly agreed otherwise in writing.

2. Services

The Contractor provides services in the field of drywall construction and interior fitting, in particular the assembly of drywall structures, wall and ceiling systems and related work. The specific scope of services results from the respective offer or contract.

3. Offer and Conclusion of Contract

Offers are subject to change and non-binding unless they are expressly marked as binding. A contract is concluded as soon as the Client confirms the offer in writing, by email or orally.

4. Prices and Payment Terms

All prices are in Euro. According to § 19 UStG, no VAT is charged or shown (small business regulation). Unless otherwise agreed, the invoice amount is due without deduction within 7 days of invoicing. In the event of late payment, the Contractor is entitled to demand default interest in accordance with statutory provisions.

5. Cooperation Duties of the Client

The Client ensures that:

• the construction site is freely accessible
• necessary permits are available
• connections (electricity, water) are available

Delays or additional costs due to lack of cooperation are at the expense of the Client.

6. Dates and Execution

Execution and completion dates are only binding if they have been expressly agreed in writing. Force majeure, material shortages or unforeseeable events entitle to a reasonable postponement of dates.

7. Acceptance

After completion of the work, acceptance is carried out by the Client. Obvious defects must be reported in writing immediately, at the latest within 7 days.

8. Warranty

Statutory warranty rights apply. No warranty is given for damage caused by:

• improper use
• normal wear and tear
• services or materials of third parties

9. Liability

The Contractor acts only for damages based on intent or gross negligence. In case of slight negligence, the Contractor is only liable for breach of essential contractual obligations and limited to the foreseeable damage.

10. Termination / Withdrawal

In the event of termination of an already placed order by the Client, services already rendered and material costs incurred must be remunerated.

11. Data Protection

Personal data is processed exclusively within the framework of applicable data protection laws. Further information can be found in the privacy policy on www.wallcraft-bau.de.

12. Final Provisions

The law of the Federal Republic of Germany applies. Should individual provisions of these GTC be or become ineffective, the validity of the remaining provisions remains unaffected.
